1. Image Ownership & Usage License

AJ Photography retains full copyright to all images created. The purchase of services provides the client with a limited usage license, not a transfer of ownership.

Grant of License: Images are licensed to the individual agent or entity who ordered the services for the sole purpose of marketing the specific property listed.

Non-Transferability: This license is non-transferable. Images may not be sold, given, or licensed to third parties (including builders, stagers, contractors, or subsequent listing agents) without express written consent and potential additional licensing fees.

Portfolio Use: Agents are permitted to use images in a "portfolio" context for personal branding (e.g., website "sold" galleries or social media highlights), provided the use is not for brokerage-wide marketing.

2. Property Readiness & "As-Is" Condition

To ensure the highest quality results, properties should be "camera-ready" upon the photographer's arrival.

Photographer Role: I will exercise a high attention to detail to showcase the home’s best features; however, I am not responsible for cleaning, staging, or moving furniture/personal items.

On-Site Discretion: The property will be photographed in "as-is" condition. I reserve the right to refuse to enter areas that appear unsafe, unsanitary, or hazardous at my sole discretion.

3. Virtual Staging & MLS Compliance

Advanced retouching and virtual staging are intended strictly as visual aids to help potential buyers conceptualize the space.

Misrepresentation: The photographer is not liable for any perceived misrepresentation of the property. It is the Agent’s responsibility to ensure that all images used in marketing comply with local MLS rules and Fair Housing regulations.

Verification: Prospective buyers should verify all physical attributes and property conditions independently.

4. Scheduling, Cancellations, & Trip Fees

Cancellation Fee: Cancellations or rescheduling requests made less than 24 hours before the scheduled shoot are subject to a $50 fee.

Trip Fee: I provide a 15-minute grace period from the scheduled start time for the property to be unlocked and “camera-ready." If the property remains inaccessible (e.g., wrong lockbox code, no key, agent/homeowner not present) or is significantly unprepared for photography after 15 minutes, the shoot will be cancelled and a $50 Trip Fee will be added to the invoice.

Weather Policy: Certain services (drones, exteriors) are dependent on cooperative weather. I monitor local conditions closely and will attempt to communicate if a reschedule is necessary. In the event of inclement weather, clients may choose to proceed with interior shots or reschedule the entire session.

5. Third-Party Services (Titus / Pay-at-Closing)

Integration with third-party payment services like Titus is provided as a convenience to the client.

Independent Relationship: Approval for "pay-at-closing" is subject to Titus’s application process. AJ Creative is not an agent of Titus and has no control over their approval criteria, interest rates, fees, or internal systems. All financial disputes regarding Titus must be handled directly with their support team.

6. Limitation of Liability

The photographer shall be held harmless for any damage to personal property or third-party injuries occurring on the premises during the photographic session. By booking a shoot, the client agrees to indemnify the photographer against any claims arising from the session.
